These Terms and Conditions (the “Terms”) govern your access to and use of the random number generator tool made available at www.purerandom.com (the “RNG” or “Service”), operated by Jammy Limited (company number 15558191) of 128 City Road, London EC1V 2NX (“we”, “us”, “our”).

By clicking “I agree” (or otherwise accessing or using the RNG), you agree to be bound by these Terms.

THESE TERMS RELATE TO THE FREE USE OF THE RNG AND BECAUSE THE RNG IS FREE TO USE IT COMES WITH VARIOUS EXCLUSIONS AND LIMITATIONS AS SET OUT IN THESE TERMS AND CONDITIONS

IMPORTANT NOTICE
  • The RNG is a general-purpose tool only.
  • The RNG is not guaranteed to be uninterrupted, error-free or suitable for any particular purpose.
  • The RNG is not intended for security-sensitive, safety-critical or regulated use unless expressly stated otherwise in writing.
  • You are solely responsible for validating Outputs and ensuring compliance with all applicable laws, regulations, standards and requirements.
  • The RNG is provided free of charge and subject to strict exclusions and limitations of liability.
  • The RNG is intended for use in the United Kingdom only (see clause 23).
  1. Definitions and interpretation

    1. Definitions
    2. In these Terms, the following words have the following meanings:
    “ASA”means the UK Advertising Standards Authority;
    “CAP Code”means the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing administered by the ASA, as updated from time to time;
    “Consumer”means an individual acting for purposes that are wholly or mainly outside that individual’s trade, business, craft or profession (and “Consumer” shall be construed in accordance with section 2(3) of the Consumer Rights Act 2015).
    “Free Tier Limits”means the operational caps, throttles, quotas, restrictions and prohibitions applying to the free version of the RNG from time to time, as set out in clause 7 (in particular clauses 7.1 and 7.3 to 7.6) and including any limits implemented technically, whether or not explicitly stated on the website;
    “Gambling Act 2005”means the Gambling Act 2005 (as amended);
    “GLI”Means Gaming Laboratories International, LLC (and its affiliates);
    “GLI Certification” and “GLI Certified”means GLI’s certification of PureRandom Hardware Random Number Generator (RNG) v1.5 dated 19th March 2026 as evidenced by https://access.gaminglabs.com/Certificate/Index?i=638
    “Outputs”means any number(s) or other results generated, displayed or otherwise produced by the RNG;
    “RNG”means the random number generator tool made available at www.purerandom.com , including any related interface, code, features and functionality;
    “Service”has the meaning given in the introduction to these Terms;
    “Terms”means these terms and conditions as updated from time to time under clause 4;
    “UK”means the United Kingdom;
    “UK GDPR”means the UK General Data Protection Regulation, as supplemented by the Data Protection Act 2018;
    “you” and “your”means the business user accessing or using the RNG and, where applicable, the business/entity on whose behalf the RNG is used.
    1. Interpretation
    2. Headings are for convenience only and do not affect interpretation.
    3. Words in the singular include the plural and vice versa.
    4. A reference to a statute includes any modification, extension or re-enactment of it and any subordinate legislation made under it.
    5. Any words following “including”, “in particular”, “for example” or similar expressions shall be construed as illustrative and shall not limit the sense of the words preceding those expressions.
  2. Business users only; no consumers

    1. B2B only
    2. The RNG is made available only to business users. By using the RNG you confirm that you are acting for purposes relating to your trade, business, craft or profession.
    3. No Consumer use
    4. You must not use the RNG as a “consumer” (as that term is generally understood under UK Consumer protection law). If you are a Consumer, you must not access or use the RNG.
    5. Authority
    6. Where you use the RNG on behalf of a business or other entity, you confirm that you have full authority to bind that entity to these Terms. You will be responsible for ensuring that any other users under your control comply with these Terms.
  3. Age requirement

    You must be 18 years of age or older to use the RNG. By using the RNG you confirm that you satisfy this requirement.

  4. Acceptance and variation

    1. Acceptance
    2. These Terms apply each time you access or use the RNG, regardless of how you access it (including via different devices, browsers or networks).
    3. Changes
    4. We may amend these Terms at any time by posting an updated version on the website. The updated Terms will apply from the time they are posted (as indicated by the “Last updated” date). Your continued use after that time constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the RNG.
  5. Licence

    1. Licence
    2. We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the RNG solely in accordance with these Terms. Any rights not expressly granted to you under these Terms are hereby expressly reserved by us and our licensors. No licence is granted by implication, estoppel or otherwise.
    3. Access and availability; suspension/termination without liability
    4. The RNG is provided free of charge. We do not guarantee that the RNG will always be available, uninterrupted, secure or error-free. We may, without any liability to you, suspend, withdraw, restrict, discontinue, terminate or change all or any part of the RNG (and/or your access to it) at any time and for any reason, including to maintain, improve, secure or protect the RNG, to comply with law, or to address misuse.
    5. No support
    6. We are not obliged to provide support, maintenance, updates or service levels for the RNG. No service level agreement applies and we give no commitment as to uptime, performance, response times, continuity, recovery times or data retention.
    7. Experimental / evolving service
    8. The RNG may contain bugs, errors or limitations. Features may be added, removed or modified without notice and Outputs may differ over time even with the same parameters.
    9. No operational guarantees
    10. We do not undertake to preserve or maintain any particular level of availability, throughput, latency, entropy quality, randomness characteristics, continuity, storage, logging or historical access.
  6. Risk

    1. Use at your own risk
    2. You access and use the RNG voluntarily and entirely at your own risk. You are solely responsible for any reliance on any Outputs and for any outcomes, decisions, actions or omissions resulting from your use of the RNG or Outputs.
    3. Compliance with laws and rules
    4. You must comply with all applicable laws and regulations and (where relevant) platform/operator rules and contractual requirements in connection with your use of the RNG and any Outputs (including without limitation laws and rules relating to gambling, prize promotions, advertising/marketing, licensing, record-keeping, Consumer protection, sanctions, export controls and data protection). You are responsible for obtaining professional advice where required.
    5. Regulated Gambling and promotions
    6. If you use the RNG in connection with gambling, wagering, lotteries, prize draws, competitions, free prize draws, instant win promotions, games of chance, or similar activities, you will ensure that:
      1. such activities are not regulated under the Gambling Act 2005 and/or other legislation and regulatory guidance;
      2. you are solely responsible for obtaining and maintaining all required permissions and ensuring that your use (including your overall process) meets any applicable requirements (including fairness, transparency, auditability, record keeping and dispute handling); and
      3. you are solely responsible for ensuring that any promotion, competition or draw using the RNG complies with all applicable CAP Code requirements, ASA requirements, Gambling Commission guidance, Consumer protection laws and other applicable regulatory requirements.
    7. No endorsement or assurance
    8. We do not represent, warrant or guarantee that the RNG (or any Outputs) complies with any legal or regulatory requirements, industry standards, or any particular use case.
    9. No testing or certification
    10. Unless expressly stated by us in writing, the RNG has not been independently tested, certified, approved or audited for compliance with any gambling, gaming, security, statistical, regulatory or technical standard.
    11. Gambling Commission standards
    12. The RNG is not intended to satisfy Gambling Commission technical standards or remote gambling and software requirements unless expressly stated otherwise in writing.
    13. No fiduciary obligations
    14. We act solely as a technology provider. We do not act as a fiduciary, trustee, escrow agent, adjudicator or independent verifier in relation to any use of the RNG or any process in which it is used. Nothing in these Terms creates any duty of care, fiduciary duty, or advisory duty beyond those which cannot be excluded by law.
    15. Sanctions and export controls
    16. You must not access or use the RNG in breach of any applicable sanctions, export control laws or trade restrictions. You represent and warrant that you are not (and are not owned or controlled by) a person that is subject to sanctions, and that you are not located in a jurisdiction where access to the RNG would be prohibited by applicable law.
    17. We do not monitor your purpose
    18. While we may monitor traffic and usage patterns for operational, security and abuse-prevention purposes (see clause 7.6), we do not monitor, verify or approve the purposes for which you use the RNG or any Outputs, and we have no responsibility for those purposes or for your compliance obligations.
  7. Restrictions, fair use, rate limits and prohibited conduct

    To protect the security, integrity and availability of the RNG (which is offered free of charge), you must comply with this clause 7. Any breach of this clause 7 is a material breach.

    1. Operational and structural caps (“one at a time”, quotas and throttles)
      1. One at a time
      2. Unless the user interface expressly states otherwise, you may request/generate one (1) random number per request. You must not attempt to obtain batches, arrays or bulk Outputs by repeated rapid requests or other means.
      3. Rate limits / cool-down
      4. We may impose and vary request-rate limits at any time (including per IP address, per user/session, per device, per geography, or by other technical identifiers). Limits may be technical, dynamic and adaptive. By way of example only, we may limit you to maximum requests per second and/or apply cool-down periods. Where you exceed a limit, requests may be rejected (including with HTTP 429 or similar), delayed, or blocked.
      5. Daily quotas / allowances
      6. We may impose and vary daily usage caps and quotas (including per IP address or other identifiers) which may reset on a schedule determined by us (for example, daily at midnight UK time or such other time as we determine). If you exceed a quota, the RNG may stop responding or may restrict access until the quota resets.
      7. No entitlement
      8. Any limits or thresholds (whether stated in the interface or not) are not entitlements. We may change them at any time to protect the RNG and our systems.
    2. Commercial use permitted (business users only) at your own risk
      1. Commercial use
      2. Business users may use the RNG (and Outputs) for commercial purposes at their own risk, subject always to these Terms, including the Free Tier Limits and the disclaimers/limitations of liability in clauses 11 and 12. For the avoidance of doubt, commercial use under these Terms is permitted only within the Free Tier Limits and is limited to interactive/manual use via the website interface. Commercial use does not permit you to use the RNG in an automated, bulk or API-like manner unless we expressly agree in writing.
      3. Higher-volume / paid service
      4. If you require higher limits, bulk generation, automation, an API, audit logs, “provably fair” mechanisms, enhanced service levels, or any other enhanced/commercial features, please contact us at mail@purerandom.com regarding a paid version or commercial arrangements.
    3. Anti-circumvention obligations
      1. No circumvention
      2. You must not attempt to bypass or circumvent any restrictions or technical controls, including rate limits, quotas, CAPTCHAs, access controls or feature gating.
      3. No IP pooling / proxying
      4. You must not distribute requests across multiple IP addresses, proxy services, VPNs, device farms, accounts, or other methods intended to evade controls or increase throughput.
      5. No botting/scraping; no automation
      6. You must not access or use the RNG by automated means (including bots, scripts, scraping tools, crawlers, automated browsing, concurrent processes, headless browsers, or programmatic calls) except where we expressly permit it in writing.
      7. No API use
      8. Unless we expressly agree in writing, the RNG is not provided as an API and you must not integrate it into automated systems, products, services or workflows.
    4. High-stakes and restricted use categories
      1. No security/cryptographic uses
      2. You must not use the RNG for any security-related purpose, including without limitation generating cryptographic keys, passwords, one-time passwords, authentication codes, tokens, session identifiers, encryption/decryption, signing or any security control requiring a cryptographically secure random source.
      3. No safety-critical / high-risk uses
      4. You must not use the RNG in any environment or for any purpose where failure, error or bias could reasonably be expected to result in injury, death, property damage, environmental damage or significant financial loss (including medical/clinical settings, aviation, transport, emergency services, critical infrastructure, industrial control systems, or regulated financial trading systems).
      5. Regulated or standards-based uses (no reliance)
      6. Where a law, regulation, code, standard, certification or audit requirement mandates a particular class of RNG (including a certified/audited RNG), you must not rely on the RNG to satisfy those requirements. You are solely responsible for determining whether the RNG is suitable and for implementing any required controls, approvals, governance and independent verification.
      7. No misrepresentation
      8. You must not represent that the RNG is certified, audited, approved, endorsed, “true random”, “provably fair”, “cryptographically secure”, or compliant with any standard or test suite unless we have expressly confirmed this in writing.
    5. Interference, abuse and unlawful use
      1. No interference
      2. You must not interfere with, damage or disrupt the RNG or any network or system used to provide it, including introducing malware or harmful code, attempting unauthorised access or attacking the RNG (including via a denial of service).
      3. Reverse engineering
      4. You must not reverse engineer, decompile or disassemble the RNG or attempt to derive source code or underlying ideas or algorithms, except to the extent permitted by applicable law.
      5. Unlawful use
      6. You must not use the RNG in any way that is unlawful, fraudulent or misleading.
    6. Monitoring, enforcement, banning and remedies
      1. Monitoring
      2. We may monitor usage for operational, security, abuse-prevention and traffic-management purposes, including to enforce these Terms and the Free Tier Limits. For the avoidance of doubt, such monitoring is focused on protecting the Service and does not constitute monitoring or approval of your purpose or compliance.
      3. Security tooling
      4. You acknowledge that we may use automated abuse-detection and traffic-management systems, including bot-detection technologies, rate-limiting technologies, behavioural analysis tools, reputation systems, device/browser fingerprinting and other security controls.
      5. Prohibition
      6. We may prohibit, suspend, restrict or ban any user (including by blocking IP address/ranges or other identifiers) at any time, with or without notice, where we reasonably believe this is necessary to protect the RNG, our systems, other users, to prevent abuse, or to manage legal, regulatory or security risk. Any such action may be taken without any liability to you, subject always to clause 12.3.
      7. Enforcement
      8. If we suspect or determine (acting reasonably) that you have breached these Terms (including clause 7), we may, without liability:
        1. throttle, suspend, restrict or terminate your access;
        2. block requests (including by IP address/range or other identifiers), temporarily or permanently;
        3. deploy additional controls (including CAPTCHAs or stricter quotas);
        4. suspend or restrict access where we reasonably believe continued operation may create legal, regulatory or security risk; and/or
        5. take any other action we reasonably consider necessary to protect the RNG, our systems and other users.
      9. Abuse-related costs (material breach)
      10. You shall be responsible for our reasonable and foreseeable excess traffic, operational, infrastructure, investigation and/or remediation costs incurred as a direct result of your material breach of clause 7 (including circumvention, botting/scraping, automation, or attacks). We will, on request, provide reasonable supporting information for such costs.
      11. Civil claims
      12. Where your breach causes loss, damage, disruption or increased costs to us or third parties (for example, through abuse, circumvention, scraping or attacks), we reserve the right to pursue all available remedies, including injunctive relief and civil damages (to the extent permitted by law).
  8. General purpose only; parameters; randomness; changes; no audit

    1. General purpose only
    2. The RNG is a general-purpose tool and is not designed to be cryptographically secure.
    3. Duplicates and sequences
    4. You acknowledge that apparently unusual results may occur in random processes, including repeated numbers, clusters and long runs, and such outcomes do not of themselves indicate error, bias or manipulation.
    5. Parameters and interpretation
    6. You are responsible for selecting parameters and interpreting Outputs. Unless the user interface states otherwise:
      1. ranges are inclusive of endpoints;
      2. Outputs may include repeats (“with replacement”) unless you select an option which expressly prevents duplicates;
      3. if you input a minimum value that is greater than a maximum value, we may swap the values, reject the request, or return no output;
      4. decimals may be rounded or truncated and negative values may be accepted or rejected depending on the options and/or the user interface; and
      5. formatting (including leading zeros, separators and locale) may vary.
    7. Your verification obligation
    8. You must check and verify Outputs before use. We have no responsibility for any decision, action or omission taken by you or any third party based on any Output.
    9. Changes
    10. We may change the RNG method, underlying libraries, hosting environment, user interface, parameter handling and/or output formatting at any time. Outputs generated at different times may differ even with identical inputs.
    11. Operational records
    12. Our records and system logs shall be prima facie evidence of access and operational activity relating to the RNG.
    13. GLI Certification
    14. Subject to these Terms:
      1. we may state that the RNG is GLI‑Certified only to the extent of the GLI certification.
      2. you acknowledge and agree that any gli certification: (i) is limited to the scope, configuration, version, environment and test criteria described in the gli certification; (ii) does not constitute and shall not be treated as any assurance, warranty or representation by us that the rng will be error-free, uninterrupted, unbiased, compliant in your use case, or suitable for any particular purpose; and (iii) does not relieve you of your responsibility to validate the RNG and Outputs and to comply with all applicable laws, regulations and standards.
      3. we do not provide any assurances, warranties or representations that the GLI Certification remains current, will apply to any modified or updated version of the RNG, or will be maintained, renewed or not suspended or withdrawn by GLI.
      4. to the fullest extent permitted by law, you agree that you will not bring any claim against us alleging that the existence of the GLI Certification creates any higher duty, obligation or standard of care than otherwise applies under these terms, and clauses 11 and 12 (disclaimer and limitation of liability) shall apply in full.
  9. Intellectual property

    1. Our rights
    2. We (and our licensors) own and reserve all intellectual property rights in and to the RNG, the website and all underlying software, code, text, graphics and design.
    3. No transfer
    4. Nothing in these Terms transfers any intellectual property rights to you. Except for the licence granted in clause 5.1, you receive no rights in or to the RNG.
    5. Outputs
    6. We do not claim ownership of the numeric Outputs generated for you. Subject to these Terms and applicable law, you may use, reproduce and share Outputs. We do not warrant that Outputs are unique or that they will not match outputs generated for other users. You are solely responsible for your use of Outputs.
    7. No endorsement
    8. You must not use our name, trademarks, logos, domain name, or the name of the RNG, nor make any statement implying our endorsement, sponsorship, affiliation, certification or approval of you, your business, your products/services or any promotion, competition or draw, without our prior written consent. This includes (without limitation) press releases, marketing materials, website references, social media posts and case studies.
    9. Feedback
    10. If you provide suggestions, ideas, enhancement requests or feedback relating to the RNG, you grant us a perpetual, irrevocable, worldwide, royalty-free, fully transferable and sub-licensable licence to use, reproduce, modify, publish, distribute and otherwise exploit them for any purpose, without restriction or compensation to you.
  10. Privacy

    1. Data processing
    2. We may process and retain personal data in connection with the operation, administration, security and protection of the website and RNG, including server logs, fraud prevention, abuse detection, traffic management, troubleshooting, analytics, rate limiting and security monitoring. This may include technical identifiers such as IP address, browser information, device identifiers, cookie identifiers and usage data and, where provided by you, user names and contact details. Where we process personal data, our Privacy Policy applies.
    3. Cookies and similar technologies
    4. We may use cookies and similar technologies (including local storage and similar identifiers) to operate the RNG, remember preferences, protect against abuse and support security and analytics. You may be able to control cookies through your browser settings; however, disabling some cookies may affect the operation, security or availability of the RNG.
    5. Usage records
    6. You acknowledge that we may keep technical records of access/usage (including date/time of requests and technical identifiers such as IP address and user agent) for security, fraud prevention, troubleshooting, analytics and enforcing these Terms and the Free Tier Limits.
  11. Disclaimer

    1. As is / as available (meaning)
    2. The RNG is provided free of charge on an “as is” and “as available” basis. This means, to the fullest extent permitted by law, that we do not provide any assurances, warranties or representations (whether express, implied or statutory) that:
      1. the RNG (or any Output) will meet your requirements or be accurate, complete, statistically random, unbiased, unique, fit for any particular purpose or compliant with any standard, certification or regulatory regime;
      2. the RNG will be uninterrupted, timely, secure, compatible with your systems or free from bugs, errors, bias, downtime, latency, outages, malware or other harmful components;
      3. any defects will be corrected or that any particular feature, algorithm, method, parameter handling or output format will continue to be available;
      4. the RNG will not be changed, limited, throttled, suspended or withdrawn; or
      5. any Output can be relied upon for any purpose.
    3. Rationale for “as is”
    4. You acknowledge that the RNG is provided free of charge, without service levels, and for general-purpose use only. The “as is” basis reflects an allocation of risk appropriate for a free service, under which you are responsible for independent validation, controls and any insurance you consider appropriate.
    5. No warranties
    6. To the maximum extent permitted by law, we exclude all conditions, warranties, representations or other terms which might otherwise be implied by statute, common law or the law of equity, including without limitation any implied terms:
      1. as to satisfactory quality;
      2. as to fitness for a particular purpose;
      3. as to merchantable quality (to the extent such concept applies);
      4. as to accuracy or completeness;
      5. as to non-infringement;
      6. as to compatibility; and
      7. as to security and availability.
    7. No advice
    8. The RNG and any related materials are provided for general information only and do not constitute advice (including legal, compliance, financial or technical advice).
    9. Third party dependencies
    10. The RNG may depend on third party services (including hosting and content delivery networks). We are not responsible for third party services, outages, changes or acts/omissions.
  12. Limitation of liability

    1. Cap
    2. Subject to clause 12.3, our total maximum aggregate liability to you arising out of or in connection with the RNG, any Outputs and/or these Terms (whether in contract, tort (including negligence), misrepresentation, restitution, breach of statutory duty or otherwise) shall be limited to £100.
    3. Excluded losses
    4. Subject to clause 12.3, we shall not be liable to you for:
      1. loss of profits (whether direct and/or indirect);
      2. loss of revenue or anticipated savings;
      3. loss of business, contracts or opportunity or wasted costs and/or expenses;
      4. loss of goodwill or reputation;
      5. loss, corruption or damage to data;
      6. any indirect or consequential loss;
      7. any claims of whatever nature against or involving you which are made by any users or third parties in relation to or in connection with the RNG; and/or
      8. loss of chance, winnings, prizes opportunity or expected outcomes.
    5. Non-excludable liability
    6. Nothing in these Terms excludes or limits liability for:
      1. death or personal injury caused by negligence;
      2. fraud or fraudulent misrepresentation; and/or
      3. any other liability which cannot be excluded or limited under applicable law.
    7. Reasonableness (UCTA)
    8. You agree that the limitations and exclusions in these Terms are reasonable having regard to the following factors:
      1. the RNG is provided free of charge;
      2. you determine the purpose for which the RNG is used;
      3. you can implement independent checks, controls and/or alternative tools; and
      4. you are better placed than us to prevent, mitigate or insure against losses arising from your use of the RNG.
    9. The parties acknowledge that the RNG is provided free of charge and that the limitations and exclusions in these Terms reflect the allocation of risk between the parties.
  13. Indemnity

    1. You shall hereby indemnify and keep indemnified us on demand from and against any and all losses, liabilities, damages, costs (including reasonable legal costs), claims, demands, proceedings and expenses suffered or incurred by us arising out of or in connection with:
      1. your access to or use of the RNG or any Outputs; and/or
      2. your breach of applicable law or regulation or third party rights.
    2. Nothing in this clause 13 requires you to indemnify us to the extent such indemnity is prohibited by applicable law.
  14. Termination

    1. Termination by us
    2. We may suspend, restrict or terminate your access to the RNG immediately and without notice to you if:
      1. we consider that you have breached these Terms;
      2. we consider that you present a security, legal or regulatory risk;
      3. we need to protect the RNG, our systems or other users; and/or
      4. we in any way discontinue the RNG.
    3. Effect of termination
    4. On termination or suspension:
      1. the licence in clause 5.1 will immediately end;
      2. you must stop accessing and using the RNG; and
      3. we may (but are not obliged to) block your access (including by IP address/range or other identifiers).
    5. Any suspension, restriction or termination under this clause 14 may be implemented without any liability to you, subject always to clause 12.3.
    6. Survival
    7. Clauses which by their nature are intended to survive termination shall survive, including clauses 1, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 18, 19, 20, 21, 22, 23 and 24. Where you have generated Outputs in compliance with these Terms prior to termination, your right to use those Outputs under clause 9.3 survives termination.
  15. Entire agreement

    1. Entire agreement
    2. These Terms constitute the entire agreement between you and us relating to the RNG and supersede all prior discussions, correspondence, negotiations, arrangements, understandings or agreements relating to their subject matter.
    3. Non-reliance
    4. You acknowledge that you have not relied on any statement, representation, assurance or warranty (whether made innocently or negligently) that is not expressly set out in these Terms.
    5. Fraud
    6. Nothing in this clause 15 limits or excludes liability for fraud or fraudulent misrepresentation.
  16. Force majeure

    1. We shall not be liable for any delay or failure to perform caused by events outside our reasonable control.
    2. Such events include (without limitation) internet failures, telecommunications failures, power outages, cyber attacks, denial-of-service attacks, epidemics/pandemics, fire, flood, acts of God, war, terrorism, civil commotion, industrial disputes, governmental actions, and failures or delays of third-party providers (including hosting, cloud or software and/or analytics providers).
    3. If a force majeure event occurs, our obligations will be suspended for the duration of the event and we may take such steps as we consider reasonable to mitigate its effects.
  17. Assignment

    2. You may not assign, transfer, charge, subcontract or otherwise deal with any and/or all of your rights or obligations under these Terms without our prior written consent.

  18. No partnership or agency

    1. Nothing in these Terms creates any partnership, joint venture, agency, fiduciary or employment relationship between the parties.
    2. Neither party has authority to bind the other or incur liability on the other’s behalf.
  19. Waiver

    1. A waiver of any right or remedy under these Terms is effective only if given in writing and shall not be deemed a waiver of any subsequent breach or default.
    2. No failure or delay by us to exercise any right or remedy shall operate as a waiver of that right or remedy, nor shall it prevent or restrict any further exercise of that or any other right or remedy.
  20. Severance

    1. If any provision (or part-provision) of these Terms is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision (or part-provision) shall be deemed modified to the minimum extent necessary to make it valid, lawful and enforceable.
    2. If such modification is not possible, the relevant provision (or part-provision) shall be deemed deleted.
    3. Any modification to or deletion of a provision (or part-provision) shall not affect the validity and enforceability of the rest of these Terms.
  21. No third party rights

    1. A person who is not a party to these Terms shall not have any rights to enforce any term of these Terms, whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
    2. The rights of the parties to terminate, rescind or vary these Terms are not subject to the consent of any third party.
  22. Governing law and jurisdiction

    1. These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of England and Wales.
    2. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms or their subject matter.
  23. UK-only use

    1. UK-only
    2. The RNG is made available for use in the UK only and is not intended for use in any jurisdiction outside the UK.
    3. No targeting outside the UK
    4. We do not represent that the RNG or any Outputs are appropriate, lawful or available for use outside the UK.
    5. Your responsibility for location and local laws
    6. You must not access or use the RNG from outside the UK. If you choose to access the RNG from outside the UK (including through the use of VPNs or other location-masking tools), you do so at your own risk and you are solely responsible for compliance with all applicable local laws and regulations.
    7. Right to restrict access
    8. We may implement geo-blocking or other restrictions to enforce this clause 23 and may suspend or terminate access where we reasonably believe the RNG is being accessed or used from outside the UK, without any liability to you (subject always to clause 12.3).
